Welcome to Remii, a service companion app (“the App”) brought to you by Insight Psychological Inc., its subsidiary, The Grief and Trauma Healing Centre, and affiliates (collectively known as “Insight Psychological,” “we,” or “us”). By accessing or using our App, you indicate that you accept, agree to comply with, and be bound by the following terms and conditions ("Terms") as applicable to the App and its usage. Please read them carefully before using the App. If you do not agree to these Terms, please do not use the App.

1. Consent

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines posted within the App. These Terms apply to all users of the App, including but not limited to patients, clients, therapists, and content contributors. If you are using the App on behalf of a minor, you accept full responsibility for complying with these Terms.

2. Eligibility

To use the App, you must be 18 years or older. If you are under the age of majority where you live, you may only use the App with the consent of your parent or guardian and if your parent or guardian agrees to our Terms. Please read these Terms with them. If you are a parent or legal guardian of a user under the age of majority where you live, you are subject to these Terms and responsible for your child’s activity on the App as well as responsible for ensuring that the use of the App is in accordance with applicable laws and regulations regarding minors.

3. User Account

You agree to provide accurate information during registration. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Notify us immediately at directors@insightpsychological.ca of any unauthorized use of your account or any other breach of security. To access certain resources, products, tools, services, events, and features, you may need to create an additional account. You agree not to create an account if we have previously removed you or your account from the App or from any service with Insight Psychological, unless we expressly agree otherwise.

4. Availability of the App

Although we aim to offer you the best service possible, we make no promise that the App will meet your requirements and we cannot guarantee that the App will be fault-free. If a fault occurs in the App, please report it to us at directors@insightpsychological.ca and we will review your concerns and, where we determine it is appropriate to do so, correct the fault. If the need arises, we may suspend access to the App while we address the fault. We will not be liable to you if the App is unavailable for a commercially reasonable period of time. Your access to the App may be occasionally restricted to allow for repairs, maintenance or the introduction of new updates. We will restore the App as soon as we reasonably can.

5. Privacy Policy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your data as described in our Privacy Policy.

6. Third-Party Content

The App may contain information about, and links to, third-party websites, resources, products, tools, services, activities, events, and features (collectively, “Third-Party Content”) that are not controlled by Insight. We provide Third-Party Content only as a convenience and do not control, are not responsible for, and make no representations or warranties regarding any Third-Party Content or their privacy practices and terms of use. To the extent permitted by applicable laws, you acknowledge sole responsibility for, and assume all risk arising from, your access to and use of such Third-Party Content.

7. Product Disclaimer

The information contained in the App is for general information purposes only. While we endeavor to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, effectiveness, suitability or availability with respect to the App or the information contained on the App for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

The App should not be considered as a replacement or substitute for the standard practices, professional judgment, skill and expertise of a health care professional. Insight Psychological will not be monitoring or considering information you may enter into the App. You agree that Insight Psychological is not responsible for examining, evaluating or validating the content, accuracy or appropriateness of any information entered into, transferred by, or delivered by the App.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE APP OR INSIGHT PSYCHOLOGICAL OR THEIR RESPECTIVE SUCCESSORS, AFFILIATES, CONTRACTORS, EMPLOYEES, THIRD-PARTY PROVIDERS, SUPPLIERS, LICENSORS, PARTNERS OR AGENTS, OR OTHER REPRESENTATIVES THROUGH OR FROM THE APP SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

8. Medical Disclaimer

The App offers tools and resources to complement but NOT replace the care and services provided to you by the health and related care professionals at Insight Psychological or by any other health care professionals outside of Insight Psychological. The App is not intended, designed, or implied to diagnose, prevent, or treat any condition or illness. Any information or materials on the App are intended for general information purposes only. They are not intended to be relied upon and are not a substitute for the advice or care of your physician or any other healthcare professional. You should always consult your physician and any other applicable health care professional if you have any questions or concerns regarding a psychological or medical condition, or if you're experiencing symptoms that may require medical attention. You should never disregard the professional medical and psychological care advice or delay in seeking it because of something you have read or received using the App.

We are not liable or responsible for any consequences of your having read or been told about such advice or other materials as you assume full responsibility for your decisions and actions, and for your use of the App. In particular, to the fullest extent permitted by law, we make no representation or warranties about the accuracy, reliability, completeness, effectiveness, or suitability for any purpose of the advice, other materials and information published as part of the App.

Please be made fully aware that the App does not provide emergency services. It does not monitor and cannot respond to any crisis or emergency situation. It is your responsibility to identify resources and provisions accessible to you for a crisis or emergency situation (especially emergency and crisis helplines and support) and to access those resources and provisions when you are in crisis or in need of immediate assistance. We are also not obligated to contact you or anyone on your behalf with respect to your condition or treatment.

YOU AGREE THAT IN USING THE APP, YOU ACCEPT ALL RESPONSIBILITY FOR YOUR USE AND ACKNOWLEDGE THAT INSIGHT PSYCHOLOGICAL IS NOT LIABLE IN ANY WAY FOR YOUR USE OF THE APP.

9. Prohibition of User Content and Conduct

You are solely responsible for your use and conduct on the App. You specifically agree you will not do any of the following:

Post, upload, create, publish, store, submit, transmit, or otherwise share any comments, information, data, text, messages, ideas, suggestions, responses, survey responses, documents, materials, or other content (collectively known as “User Content”) that:
1. is confidential and for which you do not have all necessary rights to disclose or to grant us the license described above;
2. may or does infringe, misappropriate, or violate a third-party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy, or other proprietary rights or contractual rights;
3. violates, or encourages any conduct that would violate, these Terms, the rights of any party, or otherwise create liability or violate any applicable local, state, national, or international law or regulation or would give rise to civil or criminal liability;
4. is fraudulent, false, misleading, deceptive, illegal, or promotes illegal or harmful activities or substances
5. impersonates an Insight Psychological personnel, or impersonates or misrepresents your affiliation with, any person or entity;
6. contains or depicts any statements, remarks, or claims that do not reflect your honest views and experiences;
7. you being paid by any third-party to submit or share;
8. has been repeatedly posted or of similar nature or otherwise impose an unreasonable or disproportionately large load on the App’s infrastructure or systems;
9. involves the use of misleading email or IP addresses, or forged headers or otherwise manipulated identifiers to disguise the origin of content transmitted through the App;
10. is defamatory, obscene, profane, pornographic, vulgar, offensive, unlawful, libelous, indecent, lewd, suggestive, malicious or inflammatory;
11. promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual, group, or entity;
12. is abusive, violent, or threatening or promotes violence or actions that are threatening to any individual, group, or entity;
13. is intended for spamming, “chain letters,” “pyramid schemes”, junk mail, advertisement of any type, or contains any unsolicited or unauthorized marketing and promotions, political campaigning, or any form of solicitation;
14. contains materials from a third-party website, or addresses, e-mail addresses, contact information, or phone numbers (other than your own);
15. interferes with the proper working of the App or prevents others from using the App;
16. contains any viruses, corrupted data, spyware, adware, or other potentially harmful, disruptive, or destructive files, programs, or content; or
17. in our sole judgment, is objectionable, restricts, or inhibits any other person from using or enjoying the Services, or may expose Calm or others to any harm or liability of any type;
use the App other than for their intended purpose and in any manner not permitted by these Terms, that violates these Terms or any applicable law, regulation, contract, intellectual property right, or other third-party right, or that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the App, or that could damage, disable, overburden, or impair the functioning of the App in any manner;
use the App for any purposes related to scientific research, analysis or evaluation of the App without the express written consent of Insight Psychological;
modify the App, remove any proprietary rights notices, or markings, or otherwise make any derivative works based upon the App;
develop or use any applications that interact with the App without our prior written consent;
avoid, bypass, ignore, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Insight Psychological or any of Insight Psychological’s providers or any other third-party (including another user) to protect the App and any aspect of it;
attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to maintain the App, or do anything that might discover source code;
copy, reproduce, distribute, use, publicly perform, or publicly display, mirror, or frame the App, or any individual element within the App, Insight Psychological’s or Remii’s name, any Insight Psychological or Remii trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page, without express written consent from Insight Psychological or its licensors;
use automated means, including spiders, robots, crawlers, data mining tools, or the like to access or search the App, scrape, or extract data or other content from the App;
attempt to gain unauthorized access to Insight Psychological’s or the App’s computer or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the App or interferes with the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the App;
invades or attempt to invade the privacy of other users, or collect or store any personally identifiable information from the App from other users of the App without their express permission;
request, solicit or otherwise obtain access to usernames, passwords or other authentication credentials from any user of the App, including infrastructure or systems used to provide and maintain the App, or user ID and passwords;
engage in any harassing, threatening, intimidating, predatory, or stalking conduct or use the App for unlawful purposes;
collect, use or disclose or attempt to collect, use or disclose data, including personal information, about other users without their and Insight Psychological’s consent or for unlawful purposes or in violation of applicable law or regulations; or
encourage or enable any other individual to do any of the foregoing.

Insight Psychological has the right to monitor access to or use of the App or to review any user content at any time and for any reason without notice. To the extent permitted by applicable law, we reserve the right to remove or disable access to any user, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any user to be in violation of these Terms. Our failure to enforce this section in some instances does not constitute a waiver of our right to enforce it in other instances. We have the right to investigate violations of these Terms or conduct that affects the App. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

10. Rights and Obligations in User Content Submissions

You may voluntarily choose to submit or otherwise share User Content and in doing so, you:

agree that you are solely responsible for all of the User Content that you have submitted or otherwise shared;
warrant that you own all rights in your User Content (including, without limitation, all rights to the reproduction and display of your User Content) or, alternatively, you have acquired all necessary rights to enable you to grant to us the rights in your User Content as described in these Terms;
voluntarily agree to waive all “moral rights”, “author’s rights” or similar rights in any jurisdiction that you may have in your User Content and agree that neither Insight Psychological nor its successors, affiliates, contractors, employees, members, directors, agents, third-party providers, suppliers, partners or agents, or other representatives are under any obligation of confidentiality, express or implied, with respect to the User Content;
understand and accept that Insight Psychological does not guarantee that you will be able to edit or delete any User Content you have submitted or otherwise shared;
understand and accept that Insight Psychological is not obligated to pre-screen User Content or monitor any area of the App through which User Content may have been submitted or otherwise shared;
understand and accept that Insight Psychological is not required to host, display, or distribute any User Content on or through the App and may remove at any time or refuse any submission of User Content for any reason;
understand and acknowledge that Insight Psychological is not responsible for any violations of any third-party intellectual property rights in any User Content that you submit to the App or to Insight Psychological and that you agree to pay all royalties, fees and any other monies owing to any person by reason of the User Content uploaded, displayed or otherwise provided by you to the App or to Insight Psychological;
understand and agree that Insight Psychological reserves the right to retain copies of all User Content for archival purposes; and
understand and agree that any User Content you create that is displayed on the App may continue to appear on App, even after you or we have terminated your App account, access and usage.

11. Feedback

You may choose to or we may invite you to submit comments or ideas about the App or the tools, resources, content, and features in it. By submitting any feedback, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Insight Psychological under any fiduciary or other obligation, and that we are free to use such feedback without any additional compensation to you, and/or to disclose such feedback on a non-confidential basis or otherwise to anyone.

12. Limited License Granted by Insight Psychological

Subject to your compliance with these Terms, Insight Psychological grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the App solely for your personal, non-commercial purposes (unless Insight Psychological has granted you written permission to do otherwise).

The App contains or embodies copyrighted material, proprietary material or other intellectual property of the App or its licensors, including all text, graphics, images, audio, video, tools, inventions, or other materials made available via the App. All right, title and ownership such properties remain with Insight Psychological or its licensors, as applicable. The rights to download and use the App are licensed to you and are not being sold to you, and you have no rights in them other than to use them in accordance with this License Agreement and our other Terms.

You agree that you will not and you will not assist or permit any third party to:

copy, store, remove, reproduce, transmit, modify, alter, reverse-engineer, emulate, de-compile, or disassemble the App in any way, or create derivative works of the App;
use the App or any part of them to create any tool or software product that can be used to create software applications of any nature whatsoever;
rent, lease, loan, make available to the public, sell or distribute the App in whole or in part;
tamper with the App or circumvent any technology used by Insight Psychological or its licensors to protect any content accessible through the App;
circumvent any territorial restrictions applied to the App; or
use the App in a way that violates this License Agreement or the other Terms.

Any use of the App other than as specifically authorized herein, without our prior written permission, is strictly prohibited, will terminate the license granted herein, and will violate our intellectual property rights. Subject to your mobile device configurations, you authorize us to automatically install updates to any and all parts of the App and any tools or features in the App.

13. License You Grant to Insight Psychological

You hereby grant Insight Psychological a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable and transferable right and license to:

use, store, publish, translate, reproduce, adapt, copy, modify, create derivative works based upon, publicly display, publicly perform, and distribute your User Content and any name, username, or likeness provided in connection with your User Content in all media formats and channels now known or later developed in connection with operating, marketing, and providing the App or any other Insight Psychological programs, products, and services without compensation to you, and to the extent permitted by applicable laws, you hereby waive all moral or special rights in this regard. When you post or otherwise share User Content on or through the App or on any of our public and media channels, you understand that your User Content and any associated information may be visible to others. You represent and warrant that your User Content, and our use of such content as permitted by these Terms, will not violate any rights of or cause injury to any person or entity; and
use and permit others to use your User Content in any manner and for any purpose that we deem appropriate in our sole discretion.

14. Intellectual Property

All content, features, and functionality on the App, including text, graphics, logos, and software, are the property of Insight Psychological inc. (or our affiliates and/or third-party licensors, where applicable), unless indicated otherwise, and are protected by copyright and trademark laws. You agree and acknowledge that the materials are valuable property and that other than being granted a limited, non-exclusive, non-transferable license to use the App and the materials for personal, non-commercial purposes, you shall not acquire any ownership rights in or to such materials. You may not:

use such materials except as provided for in these Terms, and any other relevant terms and conditions provided to you without our prior written permission;
use any part of the materials on the App for commercial purposes without obtaining a written license to do so from Insight Psychological; or
download, display, copy, reproduce, distribute, transmit, modify, perform, transfer, create derivative works from, sell or otherwise exploit any content, code, data or materials in the App without our prior written consent.

Any unauthorized use or violation of these Terms immediately and automatically terminates your right to use the App. If you make other use of the App, or the content, code, data or materials thereon, except as otherwise provided above, you may violate copyright and other laws of Canada, other countries, as well as applicable provincial laws and may be subject to liability for such unauthorized use. Insight Psychological will enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

15. Trademarks

The Remii logo and all other Insight Psychological product, program, or service marks including but not limited to INSIGHT PSYCHOLOGICAL, THE GRIEF AND TRAUMA HEALING CENTRE, MYPSYCHPULSE, SPRING REPRODUCTIVE AND PERINATAL WELLNESS, SPRING BUDS CHILDREN’S WELLNESS, PSYCHOWL, UP THE RABBIT HOLE PODCAST, and PSYRISK are trademarks of Insight Psychological. The absence of a trademark from this list does not constitute a waiver of Insight Psychological’s trademark or other intellectual property rights concerning that trademark. All intellectual property, other trademarks, logos, images, product names, program names, service names, slogans, displayed or referred to on or in the App are the property of Insight Psychological or third-party owners, and may not be copied, altered, removed, imitated or used, in whole or in part, without each respective owner’s prior written permission.

Your misuse of the trademarks displayed on the App or on any Insight Psychological websites and materials are strictly prohibited. Insight Psychological will enforce its trademark rights to the fullest extent of the law, including the seeking of criminal prosecution.

16. Limitation of Liability

Your use and access of the App is made “as is,” without any additional warranty, support or representations, including as to the accuracy, completeness or currency of the App or its content. Insight Psychological expressly disclaims all representations, warranties, covenants and conditions, express or implied, by operation of law or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Insight Psychological makes no representation or warranty that your use or access of the App will be uninterrupted or error-free, or that the functions of the App will meet your requirements.

You agree that in no event will Insight Psychological or its successors, affiliates, contractors, employees, members, directors, agents, third-party providers, suppliers, partners or agents, or any other party involved in creating, producing, or delivering the App or its content be responsible or liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages, including, but not limited to, lost profits, loss of savings or revenue, loss of data or goodwill, service interruption, computer damage or system failure, the cost of substitute products and services, or other economic loss, arising out of or in connection with these Terms or from the use of or inability to use the App, whether based on warranty, contract (including fundamental breach or breach of a fundamental term), tort (including negligence), product liability, or any other legal theory, and whether or not Insight Psychological has been informed of the possibility of such damage or loss or if such damage or loss was foreseeable, even if a limited remedy set forth herein is found to have failed of its essential purpose.

Unless such limits are prohibited by applicable law, in no event will Insight Psychological’s total liability arising out of or in connection with these Terms or from the use of or inability to use the App exceed the greater of: (a) the amounts you have paid to Insight Psychological for use of the App; or (b) fifty CANADIAN dollars (CAN$50), whichever is less. The exclusion and limitations of damages set forth above are fundamental elements of the basis of the bargain between Insight Psychological and you.

17. Indemnity

You will indemnify and hold Insight Psychological harmless from and against any claims brought by third parties arising out of your use or access of the App, your placement or transmission of any message, content, information, or other submissions through the App, and any breach of these Terms by you, including any use or access of the App other than as expressly authorized in these Terms. You agree that Insight Psychological will have no liability in connection with any such breach or unauthorized use, and agree to indemnify against any and all resulting loss, damages, judgments, awards, costs, expenses, and lawyers’ fees of Insight Psychological in connection therewith.

Insight Psychological reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate with our defence of these claims. You agree not to settle any matter without the prior written consent of Insight Psychological. Insight Psychological will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

18. Subscriptions and Terms of Payment

Recurring Subscriptions: A monthly or annual paid subscription can be purchased to access and use a designated suite of tools and features (“Tools”) on the App. If you purchase a subscription for the Tools, the subscription will be recurring and continuous (“Recurring Subscription”) until cancelled. You authorize Insight Psychological to automatically charge your designated payment method each month or each year, depending on the subscription you purchase, for the then-current price of your Recurring Subscription, along with any applicable taxes and fees specified, unless canceled. If we are not able to charge your payment method for your Recurring Subscription, you remain responsible for any uncollected amounts and your access to and use of the Tools may be suspended until such time that a valid payment method is restored.
Cancellation: You must cancel your Recurring Subscription at least 7 days before the end of your current subscription period to avoid being charged for the next subscription period. Only the primary account holder may cancel a Recurring Subscription and cancellation can be done within the App, with the instructions provided under “Subscription”. View our support page or contact us by email at directors@insightpsychological.ca if you need assistance with canceling a Recurring Subscription. If you cancel, you are not entitled to a refund for the fees you have already paid, but, subject to these Terms, you will continue to be able to access and use the Tools until the end of your paid subscription period.
Payment Methods and Addressing Concerns: If you purchase a Recurring Subscription, you must provide an accurate and up-to-date payment method acceptable by us. You authorize Insight Psychological to charge any purchase to your designated payment method, including the then-current price plus any applicable taxes and fees specified. No transaction is binding on Insight Psychological until accepted and confirmed by Insight Psychological. We may update your stored payment method using information provided by our payment service providers. Following any update, you authorize us to continue to charge the applicable payment method(s). You are responsible for any additional charges that your payment method provider charges.

If you have any concerns regarding any transactions, you must raise them with us first and not cancel or reverse charges through your payment method provider unless you have made a reasonable attempt to resolve the matter directly with us or otherwise as provided by applicable law. Insight Psychological reserves the right to verify your identity or request more information in connection with your purchases, and not to process or to cancel purchase requests, including if we suspect fraud or if your payment method is declined.

Refunds: You will not have the right to receive a refund for any amounts paid to us unless otherwise required by applicable law.
Changes: We may make changes to your Recurring Subscription, including price changes. We will communicate material changes to your Recurring Subscription, including any changes to the price, in advance to the email address associated with your account. If you do not agree to those changes, you can cancel your subscription.
Group Subscription: An entity (“Sponsor”) can purchase a recurring group subscription (“Group Subscription”) for their employees or members. To access the App through a Group Subscription, you must follow the instructions provided by your Sponsor pursuant to the terms of its agreement with Insight Psychological. Your ability to access and use the App through a Group Subscription may be subject to additional terms between you and your Sponsor. Once your eligibility under the Group Subscription expires, your right to access and use the App as part of that Group Subscription will automatically terminate.

19. Termination

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice.
We may terminate your access to and use of the App at any time if you violate these Terms, in our sole discretion without notice to you and to the extent permitted by applicable law.
If you have received a free 10-day trial subscription from Insight Psychological for the access to and use of the Tools, your access to and use of the Tools will be terminated at the end of the 10-day trial period unless you have chosen to purchase a Recurring Subscription for the Tools.
If you have received a free 6-month or 12-month complementary* subscription from Insight Psychological for the access to and use of the Tools, your access to and use of the Tools will be terminated at the end of the 6-month or 12-month complementary subscription period unless you have chosen to purchase a Recurring Subscription for the Tools. *Complementary subscription is only provided to clients who have purchased individual counselling or assessment services from Insight Psychological.
If you are gaining access to and use of the App through a paid Group Subscription by your sponsor, your individual access to and use of the App will be terminated if you are no longer eligible for access based on the terms of our agreement with your sponsor or when your sponsor terminates their Group Subscription to the App.

20. General Terms and Conditions

Assignment By Us

Insight Psychological may transfer its rights and obligations under these Terms to any company, firm or person at any time if it does not materially affect your rights under it. You may not transfer your rights or obligations under these Terms to anyone else. These Terms are personal to you and no third party is entitled to benefit under these Terms except as set out here.

No Waiver

No waiver of or consent to depart from the requirements of any provision of these Terms will be binding unless it is in writing and signed by Insight Psychological. If we delay exercising or fail to exercise or enforce any right available to us under these Terms, such delay or failure does not constitute a waiver of that right or any other rights under these Terms.

Force Majeure

We will not be liable to you for any lack of performance, or the unavailability or failure of the App, or for any failure or delay by us to comply with these Terms, where such lack, unavailability or failure arises from any cause beyond our reasonable control.

Severability

If for any reason a court of competent jurisdiction finds any provision of these Terms or portion thereof to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms, and the remainder of these Terms shall continue in full force and effect.

Notices

Unless otherwise specifically indicated, all notices given by you to us must be given to Insight Psychological at directors@insightpsychological.ca . We may give notice to you at the e-mail address you provide to us when you register or via push notifications.

Changes to Terms

We may also elect to notify you of changes or updates to our Terms by additional means, such as pop-up or push notifications within the App or email.

Entire Agreement

These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to their subject matter. We each acknowledge that neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these Terms or the documents referred to in them.

Governing Law

The courts of Alberta, Canada will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of this Agreement in your country of residence or any other relevant country.

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
